Matrimonial property division is not an automatic split of everything in either spouse’s name. The applicable regime, acquisition dates, funding, debts and cross-border connections must be identified.
Build the asset history
List land, homes, businesses, accounts and major debts, then record when and how each was acquired. Inherited or gifted property can raise different questions from earnings accumulated during marriage. A registered owner and an economic claim between spouses are distinct concepts. Existing agreements and the couple’s nationality or residence history can affect the applicable law and should be reviewed before calculating a share.
Coordinate preservation and final recovery
If an asset may be transferred, ask whether lawful interim protection is available and what evidence is needed. A foreign divorce’s property terms do not automatically alter the Turkish land register. Valuation, tracing funds and accounting for debt may require expert evidence. Settlement wording should distinguish payment obligations from official transfers and explain how each will actually be completed.
An agreed divorce still needs judicial scrutiny
Where Turkish Civil Code Article 166/3 applies, an uncontested divorce requires a marriage lasting at least one year and agreement on the necessary financial and child-related arrangements. The judge must hear both spouses personally and be satisfied that their decision is free. A signed settlement or power of attorney alone does not replace that requirement. In a contested case, grounds, evidence and procedural deadlines become central. A dispute about one issue should not be hidden behind an “agreed” label.
Plan the document chain and the time
A useful file contains the marriage record, addresses for service, relevant orders and a concise chronology. Foreign public documents may need authentication and a suitable Turkish translation. A hearing date is not the same as finality, and a final judgment is not the same as recognition abroad. Time depends on service, evidence, the court’s work, disputed issues and appeals. A reliable initial discussion identifies those variables instead of promising a fixed completion date.
