Divorce representation may require specific authority and formalities. The instrument should be prepared for the actual family-law work rather than copied from a general civil mandate.
Define the powers deliberately
Filing or defending a divorce, dealing with settlement, waivers, appeals and related financial claims can involve distinct authority questions. The lawyer should explain which powers are necessary and what decisions remain yours. Confirm any photograph and form requirements before signing abroad.
A power does not remove personal hearing requirements
In an uncontested divorce under Article 166/3, the judge must hear both spouses personally. A representative cannot simply replace their consent hearing. If children, property or a foreign judgment are also involved, the legal work and documents may extend beyond the divorce itself. Agree scope and fees separately from the notarial authority.
Consular and local notarial routes
A Turkish consular mission may provide a notarial route for eligible applicants and transactions. Appointment, identity, language and supporting-document requirements must be checked with that mission. A local notary abroad may be another route, but the instrument must still meet the Turkish recipient’s requirements. Property transactions can require a particular form and photograph. Foreign corporate representation may require a distinct authority chain and should not be assumed to follow the individual route.
Sending, limiting and revoking authority
Have the draft and a clear scan reviewed before sending an original. Confirm the receiving address directly, use traceable delivery where appropriate and retain a full copy. Revocation involves more than deleting a digital copy or sending an informal message; the representative and relevant institutions may need effective notice. An expiry date or scope limitation should be deliberate. A power of attorney does not itself settle the lawyer’s fee or create permission to act outside the agreed engagement.
