THE SHORT ANSWER

A legal property review examines the proposed transaction and the records lawfully available within an agreed scope. Ownership, encumbrances, restrictions, representation and contract terms are separate checks. A clean-looking document or an estate agent’s assurance is not a guarantee of a safe purchase.

Separate the property from the sales presentation

Obtain the actual land registry identifiers and match them to the property being offered. Confirm the registered owner, share and capacity to transfer. A brochure, map pin, utility bill or copy of a title deed may be useful evidence, but none alone establishes the current legal position. Registry entries can change, so the timing and freshness of the information matter. Payment should be tied to a legally workable closing process.

  • Match parcel, building and independent unit identifiers.
  • Review current ownership and registered restrictions.
  • Check the seller’s identity or corporate signing authority.
  • Define how deposits, balance payments and transfer will be coordinated.

Know what a legal check includes

The agreed work may cover ownership, mortgages, attachments, annotations, power of attorney and the sale contract. Access depends on legal entitlement, authority and the available records. Matters such as planning compliance, occupancy, construction defects, seismic condition and valuation may require separate official enquiries or qualified technical professionals. A legal check should state what was examined, when it was examined, what could not be verified and what further evidence is needed.

Foreign acquisition and immigration are separate

For foreign purchasers, the buyer’s nationality, legal status, type of property and location can affect eligibility and restrictions. Property ownership is not an automatic grant of a residence permit, work permission or citizenship. An investment-linked application has its own current conditions and administrative assessment. A lawyer can help distinguish these workstreams without turning a property transaction into a guaranteed immigration product.

If something has already gone wrong

Keep the contract, payment trail, correspondence and the earliest reliable version of the property records. A title claim, damages claim, contract termination, enforcement action or criminal complaint may have different purposes and requirements. Urgent interim protection may be relevant where a disposal is threatened, but it is not automatic. Never assume that filing a criminal complaint freezes a title or repays the purchase price. The remedy must match the legal problem.
