If a Turkish relative may have left assets, first confirm the death, your family relationship and the evidence that connects the estate to a particular property, bank or company.
Reconstruct the family record carefully
Overseas births, marriages and name changes may not all appear in the same registry. Missing registration can affect proof even when the family relationship is clear to relatives. Collect the records that bridge the gap rather than relying on an informal family tree. The deceased’s citizenship at death and your own nationality may raise different legal questions.
Act on uncertainty without assuming ownership
A family home may belong to another person, a company or several co-owners. An old address may be a lead but not a title reference. Ask for a defined initial review that separates heirship, asset enquiry and urgent debt or renunciation issues. Do not sign a distribution agreement or give broad sale authority until you understand what is actually in the estate and the rights of the other heirs.
Different assets can raise different legal questions
Article 20 of Law No. 5718 generally links succession to the deceased’s national law, while Turkish law applies to immovable property in Turkey. Other issues, including opening, acquisition and partition of the estate, have their own connecting rules. A foreign probate appointment or European document therefore should not be treated as automatic authority over Turkish property. Eligibility to hold land and registry restrictions must also be checked for a foreign heir.
From heirship to usable ownership
The practical sequence may include recording the death, proving family links, obtaining an inheritance certificate, investigating assets and debts, addressing tax formalities, registering property and arranging distribution. A dispute about heirship, a will, lifetime gifts or possession may require a separate claim. Co-heirs should not assume that one heir can sell the whole property. Agree representation and authority in writing, and distinguish a lawyer’s mandate from authority granted by other heirs.
