An inheritance power of attorney should reflect whether the lawyer will establish heirship, investigate assets, conduct litigation, collect funds or arrange a sale.
Separate procedural work from disposal
Authority to apply for an inheritance certificate does not necessarily cover withdrawing money, settling a dispute or selling inherited property. Explain your objective and any limits. Renunciation can involve special authority and urgent timing. Co-heirs may need their own instructions and documents.
Check the estate before giving broad powers
Unknown liabilities, a disputed will or uncertainty about ownership can change the appropriate mandate. Keep the authority no broader than the agreed task requires. If the estate includes land and a sale is planned, property-specific formalities may be relevant. A foreign probate appointment is not a substitute for checking the Turkish representation requirements.
Consular and local notarial routes
A Turkish consular mission may provide a notarial route for eligible applicants and transactions. Appointment, identity, language and supporting-document requirements must be checked with that mission. A local notary abroad may be another route, but the instrument must still meet the Turkish recipient’s requirements. Property transactions can require a particular form and photograph. Foreign corporate representation may require a distinct authority chain and should not be assumed to follow the individual route.
Sending, limiting and revoking authority
Have the draft and a clear scan reviewed before sending an original. Confirm the receiving address directly, use traceable delivery where appropriate and retain a full copy. Revocation involves more than deleting a digital copy or sending an informal message; the representative and relevant institutions may need effective notice. An expiry date or scope limitation should be deliberate. A power of attorney does not itself settle the lawyer’s fee or create permission to act outside the agreed engagement.
